Pharia, LLC's name may not sound familiar to you. That's because this is probably the first time you've heard of them. Pharia, LLC doesn't lend money itself. Instead, the company buys debt from lenders who don't want to collect it themselves. They bought your debt, and now they're coming to collect it.
Respond to debt collectors in 15 minutes with SoloSuit.
Pharia LLC purchases charged off and delinquent accounts from an array of companies operating in different sectors of the economy, though most notably in the auto loan sector.
With the assistance of SoloSettle, you can take proactive steps to try and negotiate a debt settlement where you wind up only paying only a percentage of what is actually owed. Many debt collectors, including Pharia LLC, may be amenable to accepting such a settlement for an amount less than what you owe. This is because, despite the reduced amount, they are still successfully collecting on the debt.
By way of background, debt settlement generally involves paying a portion of your total debt. You agree to make the settlement payment in order to clear your name of the debt and dismissal of the debt collection lawsuit. If you're experiencing unexpected financial hardship, most creditors and debt collectors are willing to work with you, whether that's settling for a smaller, lump-sum payment or working out a payment plan that works with your budget.
If debt settlement sounds like a viable option for you, one of the first steps is to determine how much you can reasonably afford to pay toward the amount owed. Once your figure out that number (or possibly a settlement range), you should start communicating with Pharia LLC. Generally speaking, the higher your settlement offer, the more likely Pharia LLC will accept it.
As a general rule of thumb, consider offering anywhere between 40 percent and 60 percent of the debt’s total value. Bear in mind that you may need to engage with a back and forth with Pharia LLC before you reach a settlement agreement.
To learn more about the debt settlement process, watch the following interview with a consumer rights attorney, John Skiba, where he shares the best tips for negotiating debt settlement with collectors:
SoloSettle is a tech-based approach to debt settlement. Our settlement platforms helps you send and receive settlement offers until you reach an agreement with the collector. Once an agreement is reached, we’ll help you manage the settlement documentation and transfer your payment to the creditor or debt collector, helping you keep your financial information private and secure.
A lawsuit is one way collection agencies can pursue a debt. However, they're also one of the most expensive. Debt collection lawsuits are usually reserved for clients who are difficult to find or refuse to pay. Below, we'll cover some language that applies to any debt collection case.
Now that you understand some of the legalese involved in debt collection suits, we can look at how they work.
Use SoloSuit to file an Answer fast and block a default judgment.
A debt collection lawsuit begins when the plaintiff serves the complaint to the defendant. Once that happens, it's go-time. In most jurisdictions, you only have between 14 and 30 days to reply with your Answer.
Thus, your first order of business will be to draft and file an Answer. In your Answer, you have the chance to tell the court why you're not responsible for the debt in question. The court will only accept a few specific reasons for your innocence. These reasons are called “defenses,” and include several tactics.
Pick the right affirmative defense with SoloSuit.
The court will only see these reasons as legitimate reasons for non-payment of debt. Your Answer can't contain reasons you didn't pay your debt or a promise to do so in the future. You must prove one (not all) of these court-accepted defenses.
Make sure you file your Answer within the court-appointed timeline in your jurisdiction. If you don't, Pharia LLC will automatically win the case against you. That's bad news.
Also, keep in mind that filing an Answer is only the start of resolving a debt lawsuit against Pharia LLC. While it will block a default judgment, it won’t guarantee a victory in court. So, consider negotiating with Pharia LLC before your court date to settle the debt without the lengthy and costly court process.
The vast majority of debt collection cases never get past a Complaint. Most defendants ignore the case against them and lose by default.
If Pharia LLC wins their case, they can begin pursuing your income and assets. One of the most common tools they use to do this is called garnishment.
In everyday English, a garnishment is a delightful edible addition to a food dish. Chefs may use garnishments to enhance flavor or make the colors of a dish “pop.”
In legalese, garnishments are a different animal. They're a court order to take a portion of any income you make. Creditors can garnish paychecks, alimony, child support - basically any source of income.
Don't let either of these outcomes happen to you. Make sure to respond with your Answer within the court-appointed time frame!
Ok, so you've determined that it's important to Answer Pharia LLC's Complaint. But how do you proceed? Contrary to popular belief, you don't need a lawyer to win a debt collection case. You can successfully represent yourself - and many people do. It won't be easy, and you'll need a guide.
Start with SoloSuit. An easy 15-minute questionnaire is all it takes to generate your personalized Answer. It's completely free, with no hidden fees or costs. Our on-staff attorneys will review your paperwork for errors and file it with the court for you. Don't let Pharia LLC get away with your money. Get on the path to your financial freedom.
