Summary: To resolve debt with Day Knight & Associates, first verify the debt by sending a Debt Validation Letter within 30 days of their notice. If validated, consider options like full payment, settling for less, or a payment plan. If sued, respond with an Answer to avoid default judgment and negotiate a settlement.

It’s tempting to just ignore debt notices and hope they go away. Unfortunately, the longer you drag things out, the more complicated resolution becomes. The truth is that you have many more options besides paying in full. Take a closer look!

What is Day Knight & Associates?

Day Knight & Associates is a debt collection agency that specializes in medical debt Headquartered in Missouri, the agency collects a number of types of other debts, including credit cards, retailer financing plans, and payday loans. You can contact Day Knight & Associates at:

  • Address: 500 Northwest Plaza Dr STE: 300, Saint Ann, MO 63074-2218
  • Phone: 636.405.1000
  • Toll free: 866.915.1999
  • Email: help@dayknight.com

Notably, Day Knight & Associates also does business under the name Crown Holdings LLC. That’s the name its Better Business Bureau (BBB) profile is under. To get a better sense of the company, it helps to check its BBB profile.

Day Knight & Associates has a BBB rating of A+, but it’s not BBB accredited. It has no reviews and only five complaints were submitted against it over the past few years. This could be because a lot of people can’t find the BBB page for Day Knight & Associates since it’s under a different name.

You can also learn more about the agency by checking the Consumer Financial Protection Bureau (CFPB). Day Knight & Associates has dozens of complaints there, also under the name Crown Holdings LLC.

Many of the complaints mention inaccurate credit reporting. They also claim that the company tried to collect debts that were already paid and failed to validate debts when asked. Let’s take a look at a real Day and Knight Associates review:

“I continue to get collections notices for $49.00 through this agency. The bill has been paid. I called the doctor who the bill was for to verify that the bill has been paid. They have reported it to the credit bureau and it is affecting my credit. I'm trying to buy a house and it is impacting me. The doctor's office has all the reference numbers that it has been paid and the account is cleared.”

Ask Day Knight & Associates to verify your debt

If you’ve just gotten a notice from Day Knight & Associates saying you owe money, don’t jump to pay it in full. You have a few different repayment options — if you have to repay it at all.

The first thing you should do if Day Knight & Associates says you owe money is to ask for proof. Under the Fair Debt Collection Practices Act (FDCPA), you have the right to ask a debt collector to send documents proving you owe the debt.

You need to make this request with a Debt Validation Letter. But keep in mind that you only have 30 days from the first notice to send it! Check out SoloSuit’s video guide to making a Debt Validation Letter:

If Day Knight & Associates doesn’t respond or cannot validate the debt, you’re off the hook. If they send proof, it’s time to start thinking about repayment options. Here are a few:

  • Pay the amount in full. Paying the amount in full is the most straightforward option. It’s also worth asking for a pay-for-delete, which is when a collector agrees to take the bill off your credit report if you pay in full.
  • Settle for less than you initially owed. You also have the option to negotiate with the collector to see if they’ll accept a lesser amount.
  • Negotiate a payment plan. If you can’t pay all at once, consider asking the Day Knight & Associates if you can pay in installments.

You can still resolve your debt after a lawsuit

If you’ve been sued by Day Knight & Associates, resolving your debt gets a little more complicated. However, it’s still doable!

File an Answer

If Day Knight & Associates files a lawsuit against you, you’ll receive two documents: a Summons and a Complaint. The Summons tells you you’re being sued, and the Complaint tells you why.

Each state has a unique deadline to respond to a lawsuit. If you miss the deadline, Day Knight & Associates will win by default. That means you might have your wages garnished or even have money taken right out of your bank account.

Once you know your state’s deadline, you need to write an Answer. This is a letter that shows you want to fight the lawsuit. When you work with SoloSuit, you can draft your Answer in minutes, and we’ll send it where it needs to go.

Settle your debt

After you send your Answer, you can take steps to resolve your debt by settling. Almost all debt lawsuits are settled before they get to the courtroom — trials are long and expensive!

When you settle a debt, you can start negotiations by making an offer to Day Knight & Associates. It’s a good rule of thumb to start by offering 60% of the original amount. You might need to go back and forth with the collector a bit, but once you both agree on an amount, you can pay and get it over with.

Know how to deal with debt collectors

Communicating directly with a debt collector can be stressful, and moving through the negotiation process is difficult and confusing. Fortunately, SoloSuit can help with both. When you use SoloSettle, we’ll help you communicate directly with the collector. And once you agree on a settlement amount, we’ll help you arrange payment.

This process can be complicated, so let’s look at an example.

Example: Tom and Fred each receive a Summons and Complaint from Day Knight & Associates. Each one is being sued for $2,000. They live in Arizona, so they use SoloSuit’s deadline calculator to find out they have 20 days to respond. Tom forgets about the lawsuit and does nothing. Fred uses SoloSuit to create and send an Answer letter. Now that he’s clarified that he wants to fight the lawsuit, he works with SoloSettle to try to settle the debt for less. Eventually, Fred and Day Knight & Associates agree on $1,200. SoloSuit helps Fred arrange payment, and then he’s done with his debt. So what about Tom? Because Tom didn’t respond to the Summons, the court issued a default judgment against him. Now, Day Knight & Associates are garnishing his wages, and they’ll continue to do so until Tom has paid the full $2,000.
